Guidance for Buying or Selling an Easemented Property

Are you selling your easemented property? As the seller, it is your responsibility to inform the buyer that the property is protected by a conservation easement held by The L'Enfant Trust. If you need a copy of the Deed of Gift, please contact us. We also encourage you to share our Property Owner's Guide with the buyer.

Are you purchasing an easemented property, or are you a real estate agent working on behalf of a prospective buyer?

  • Request a copy of the Conservation Easement Deed of Gift from the seller or the Trust. Review the Deed of Gift so that you fully understand the property rights of the Trust and the terms of the easement.
  • The seller or the buyer can request an Estoppel Certificate from the Trust verifying that there are no existing easement violations on the property. The fee for an Estoppel Certificate is $200, made payable by check to The L'Enfant Trust.
